Worked example: Variance or nonconforming use?

Scenario. A zoning amendment increases the required setback. A house built legally ten years earlier now sits inside the new setback. The owner has not requested permission to build anything new.

Reason it through. The existing structure is a lawful nonconforming use or structure, often called grandfathered in ordinary speech. A variance is permission to depart from a rule, usually based on the required showing. The property did not need a variance merely because the rule changed after lawful construction.
